Terms of Hire
Terms of Hire, Disclaimer and Surveillance Notice · Version 1.0 · Effective 20 August 2026
Operator: 29 Macquarie Street Pty Ltd (ABN 63 701 124 692) ("we", "us", "our", "the Operator").
Premises: 29 Macquarie Street, Prahran, Victoria 3181 (the "Studio").
Summary — what you agree to when you book
By completing a booking, you confirm that you have read and agree to these Terms of Hire for 29 Macquarie Street Studio, and that:
- You are responsible for damage. You are liable for any damage, loss, excessive soiling, or removal of property caused by you or anyone you bring to the Studio, and for any cleaning or repair costs beyond normal use.
- A $400 refundable deposit applies. It is refunded in full within 5 business days if you leave the Studio on time, clean, and undamaged. If something is damaged, only the properly assessed cost is deducted and the balance is refunded.
- Your card may be charged. You authorise 29 Macquarie Street Pty Ltd to charge the payment card used for this booking — during or after your booking period — for damage, loss, cleaning, or overstay costs beyond the deposit, after you have been given an itemised written account of those costs and 5 business days to respond.
- Overstaying costs $150 per hour. Charged in 15 minute increments after a 15 minute grace period, plus any loss caused to a following booking.
- No shoes on the cyclorama. Only models may stand on the cyc, and only barefoot or in clean shoes supplied for the shoot. Everyone else stays off it. Damage to the cyclorama is assessed and billed immediately.
- The Studio is under video surveillance. You give your express consent, including for the purposes of the Surveillance Devices Act 1999 (Vic), to CCTV video recording and observation of the studio room activities in the monitored areas of the Studio. You will inform every person you bring with you before they attend, and you will obtain their consent.
- You enter at your own risk. You have read and accept the disclaimer and limitation of liability below.
1. Agreement to these terms
1.1 These terms form a binding agreement between 29 Macquarie Street Pty Ltd and the person or entity making the booking (the "Hirer", "you", "your").
1.2 You agree to these terms when you do any of the following: submit a booking request, pay a booking fee or deposit, tick the acceptance box at checkout, or enter the Studio.
1.3 You are responsible for ensuring every person you bring to, admit to, or permit to remain at the Studio — including your employees, contractors, crew, models, talent, clients, guests, and invitees (together, your "Guests") — is made aware of and complies with these terms. You are liable for their acts and omissions as if they were your own.
1.4 If you are booking on behalf of a company or other entity, you warrant that you are authorised to bind that entity, and you agree to be personally liable alongside it for all amounts payable under these terms.
2. Booking, payment, and card authority
2.1 A booking is only confirmed when we issue written confirmation and the required payment or deposit has been received in cleared funds.
2.2 Card on file. You authorise us to retain the details of the payment card used to make the booking (or an alternative card you nominate in writing) securely with our payment processor for the purposes set out in these terms. We do not store full card numbers ourselves.
2.3 Authority to charge. You irrevocably authorise us to charge that card, without further authorisation from you, for:
- (a) the balance of any hire fee that remains unpaid;
- (b) overstay fees under clause 4;
- (c) additional cleaning or waste removal under clause 6;
- (d) the cost of repairing or replacing damaged, lost, or removed property under clause 7; and
- (e) any other amount properly payable by you under these terms.
2.4 When we can charge. We may exercise the authority in clause 2.3 during your booking period or at any time after it, including after you have left the Studio, where the relevant cost was caused by your booking. Damage or loss is frequently only identified after a booking ends, and this clause survives the end of your booking period.
2.5 How we will charge. Subject to clause 3A.5 (cyclorama damage, which is charged immediately), before charging your card under clause 2.3(c), 2.3(d), or 2.3(e), we will:
- (a) give you written notice by email to the address on your booking, setting out an itemised account of the amount claimed;
- (b) include reasonable supporting evidence, which may include photographs, surveillance footage stills, quotes, invoices, or a replacement cost schedule; and
- (c) allow you 5 business days to respond, provide information, or dispute the claim.
We will consider any response you provide in good faith before charging. Nothing in this clause limits your rights to dispute a charge with your card issuer or under the Australian Consumer Law.
2.6 Time limit. We will not charge your card under clause 2.4 for damage, loss, or cleaning more than 30 days after the end of your booking period, unless the damage was not reasonably discoverable within that period (for example, concealed damage to services, plumbing, or structure).
2.7 Amounts must be reasonable. Any amount charged will be limited to our reasonable and actual costs of repair, replacement, cleaning, or make-good, and will not exceed the cost of restoring the Studio to the condition it was in immediately before your booking, fair wear and tear excepted. Where an item is repairable, we will charge the cost of repair rather than replacement. Where an item is replaced, we will charge the depreciated replacement value, not the original purchase price, unless replacement at full cost is genuinely necessary.
2.8 Failed charges. If a charge is declined, reversed, or charged back, the amount remains a debt owed by you and is payable within 7 days of demand. You are liable for our reasonable costs of recovering it, including any payment processor fees and reasonable debt recovery costs actually incurred.
2.9 Refundable damage deposit.
- (a) A refundable damage deposit of $400 is payable before your booking. We may take this as a payment or as a pre-authorisation hold on your card.
- (b) The deposit is refunded in full where you vacate the Studio at or before the end of your booking period, leave it in the condition required by clauses 5 and 6, and cause no damage or loss.
- (c) Where an amount is properly payable by you under these terms, we will deduct only that amount from the deposit and refund the balance. The deposit is not forfeited in whole because of a partial claim. Any deduction is subject to the notice, itemisation, evidence, and 5 business day response process in clause 2.5.
- (d) The deposit, or the balance of it, will be refunded or the pre-authorisation released within 5 business days of the end of your booking period, or within 5 business days of the resolution of any claim notified under clause 2.5, whichever is later.
- (e) The deposit is not a cap on your liability. If your liability under these terms exceeds $400, we may charge the excess to your card under clause 2.3.
3. Use of the Studio
3.1 You may use the Studio only for the purpose stated in your booking, only during your booking period, and only for the number of people stated in your booking.
3.2 You must comply with all reasonable directions given by us or our staff, all Studio house rules displayed on site or provided to you, all building rules, and all applicable laws.
3.3 You must not, without our prior written consent:
- (a) affix anything to, paint, drill, nail, screw, adhere to, or otherwise alter any wall, floor, ceiling, window, or fixture;
- (b) move, dismantle, or reconfigure any furniture, equipment, lighting rig, or fixture;
- (c) use haze, smoke, fog, pyrotechnics, naked flame, confetti, glitter, water, sand, paint, oil, food dye, or any other substance likely to stain, mark, or leave residue;
- (d) bring animals onto the premises, other than an assistance animal;
- (e) sub-hire, assign, or share the Studio with any third party;
- (f) exceed the maximum permitted occupancy or the electrical load of the premises; or
- (g) produce, record, or distribute any content that is unlawful, defamatory, sexually explicit, or that would reasonably bring the Studio, the building, or its other occupants into disrepute.
3.4 Smoking and vaping are prohibited anywhere on the premises. Alcohol is not permitted unless approved by us in writing, and then only in accordance with any conditions we impose.
3.5 You must not do anything that could invalidate the insurance on the premises or the building, or that could cause a nuisance to other occupants or neighbours.
3A. The cyclorama
3A.1 The cyclorama (the "cyc") is a painted seamless surface. It marks, scuffs, chips, and stains very easily, and it can only be restored by professional resurfacing and repainting. The following rules are strict and are not waived by us verbally on the day.
3A.2 No shoes on the cyc. No person may step, stand, walk, kneel, or place any footwear on the cyclorama, with the sole exception of the model or talent being photographed or filmed, and then only:
- (a) barefoot, in socks, or in clean shoes that have not been worn outside and are brought onto the cyc for the shoot only; and
- (b) where footwear is worn, with the soles cleaned or taped immediately before stepping onto the cyc.
3A.3 Crew, photographers, assistants, stylists, clients, and all other Guests must remain off the cyc at all times, in all footwear.
3A.4 You must not, on or against the cyc: drag, slide, or set down any equipment, stand, case, ladder, trolley, furniture, or prop; use tape, adhesive, pins, or fixings; or use liquid, paint, oil, food, glitter, or any substance capable of staining.
3A.5 Damage to the cyc is billed immediately. Because cyc damage is visible at pack-down and because we cannot re-let the Studio until it is rectified, any damage, marking, scuffing, staining, or chipping of the cyclorama caused by you or your Guests will be assessed at the end of your booking and charged to your card on the same day, together with an itemised invoice and photographs of the damage. Clause 2.5 applies except that the 5 business day period runs after the charge rather than before it, and if you dispute the charge and we accept your dispute, we will refund it within 5 business days. Your rights under clause 8.6 and your right to dispute a charge with your card issuer are not affected.
3A.6 Charges under clause 3A.5 may include the cost of spot repair, full resurfacing or repainting, and hire fees lost while the cyc is unusable, calculated in accordance with clauses 2.7 and 7.2(d).
3A.7 If you are unsure whether something is permitted on the cyc, ask us before you do it.
4. Access, booking period, and overstay
4.1 Your booking period includes all set-up, shooting or use, pack-down, and cleaning time. Please build these into the time you book.
4.2 You must vacate the Studio, and remove all of your property, by the end of your booking period.
4.3 Overstay fee. If you remain in the Studio beyond your booking period, you will be charged an overstay fee of $150 per hour, unless a different rate has been agreed with us in writing before your booking.
- (a) The fee is calculated in 15 minute increments of $37.50, or part of an increment.
- (b) A grace period of 15 minutes applies. No overstay fee is charged if you vacate within 15 minutes of the end of your booking period.
- (c) The fee is charged to your card under clause 2.3(b).
4.4 If your overstay causes us to lose, delay, shorten, or refund a subsequent booking, you are also liable for that loss, in addition to the overstay fee.
4.5 We may enter the Studio at any time during your booking for safety, security, maintenance, or compliance reasons.
5. Condition of the Studio and inspection
5.1 You must inspect the Studio at the start of your booking period and notify us immediately in writing of any pre-existing damage, defect, or hazard. If you do not, the Studio is deemed to have been in good, clean, and undamaged condition at the start of your booking.
5.2 We may photograph or video the condition of the Studio before and after each booking for the purposes of assessing damage. Those records may be used as evidence under clause 2.5(b).
5.3 You must report any damage, spill, breakage, or incident to us immediately, and in any event before you leave the premises. Failure to report an incident does not reduce your liability and may increase it where the delay worsens the damage.
6. Cleaning and removal of property
6.1 You must leave the Studio in the same condition and configuration in which you found it, including removing all rubbish, equipment, props, wardrobe, catering, and personal property.
6.2 If the Studio requires cleaning beyond a standard changeover clean, or if rubbish or property is left behind, we may charge you our reasonable cleaning, waste removal, or storage costs under clause 2.3(c).
6.3 Property left at the Studio is left entirely at your risk. We are not a bailee of it. If property is not collected within 7 days of the end of your booking, and after we have made reasonable attempts to contact you, we may dispose of it and charge you the reasonable cost of disposal.
7. Damage, loss, and liability for the Studio
7.1 You are liable for all damage to, loss of, theft of, or removal of any part of the Studio, the building, or any furniture, equipment, fixture, fitting, artwork, prop, or other property at the Studio, where caused or contributed to by you or your Guests during your booking period.
7.2 Your liability under clause 7.1 extends to:
- (a) the reasonable cost of repair or, where repair is not reasonably practicable, replacement, calculated in accordance with clause 2.7;
- (b) the reasonable cost of specialist cleaning, resurfacing, or repainting;
- (c) any insurance excess we are required to pay; and
- (d) hire fees we lose because the Studio or an item cannot be hired out while the damage is being rectified, limited to a maximum of 7 days of lost hire at our standard published rate.
7.3 You are not liable under this clause 7 for fair wear and tear, or for damage caused by us, our staff, or our other hirers, or by a defect in the premises that was not caused or contributed to by you.
7.4 Amounts payable under this clause 7 may be charged to your card in accordance with clause 2.
8. Disclaimer, assumption of risk, and limitation of liability
8.1 You use the Studio at your own risk. You acknowledge that use of a studio space involves inherent risks, including risks arising from lighting and rigging equipment, electrical equipment, stairs, hard and potentially slippery surfaces, cables, props, sets, moving equipment, and the acts of other people present.
8.2 To the maximum extent permitted by law, and subject to clause 8.6, we are not liable to you or your Guests for any loss, damage, injury, illness, cost, or expense arising out of or in connection with your use of the Studio, including:
- (a) personal injury, illness, or death;
- (b) loss of, damage to, or theft of your property or your Guests' property, whether left at the Studio during or after your booking;
- (c) loss or corruption of data, images, footage, or creative work;
- (d) any indirect or consequential loss, loss of profit, loss of opportunity, loss of anticipated savings, or loss of reputation; or
- (e) any failure, interruption, or unavailability of power, internet, water, air conditioning, lighting, lifts, or building access.
8.3 We make no warranty that the Studio will be suitable for your particular purpose. You are responsible for satisfying yourself, before booking, that the Studio, its dimensions, its natural light, its power supply, and its facilities meet your requirements.
8.4 We are not liable for any failure or delay in performing our obligations caused by an event beyond our reasonable control, including fire, flood, storm, power failure, building closure, industrial action, government direction, pandemic, or an act or omission of the building owner or manager.
8.5 Cap on our liability. Subject to clause 8.6, our total aggregate liability to you arising out of or in connection with your booking, however arising, is limited to the total hire fees you paid for that booking.
8.6 Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law, where to do so would be unlawful. Where our liability under a consumer guarantee cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the services or paying the cost of having the services resupplied. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.
9. Indemnity
9.1 You indemnify us, and our officers, employees, and contractors, against all claims, liabilities, losses, damages, costs, and expenses (including reasonable legal costs on a solicitor–client basis) that we suffer or incur arising out of or in connection with:
- (a) your breach of these terms;
- (b) any act or omission of you or your Guests at the premises;
- (c) any claim brought by a Guest, model, talent, contractor, or third party in connection with your booking; or
- (d) any content produced at the Studio during your booking, including any claim for defamation, breach of privacy, or infringement of intellectual property.
9.2 This indemnity is reduced proportionately to the extent that our negligence or wilful misconduct caused the relevant loss.
10. Surveillance and consent
10.1 You are being recorded. The Studio and its common areas, entrances, and exits are under continuous video surveillance (CCTV). Cameras are overtly installed and signage is displayed at each entrance.
10.2 Your express consent. By booking, entering, or remaining at the Studio, you acknowledge, agree, and give your express consent to being visually recorded and observed by video surveillance, and to us collecting, holding, using, and disclosing that footage in accordance with these terms and our Privacy Policy.
10.3 Consent under the Surveillance Devices Act. For the purposes of section 7 of the Surveillance Devices Act 1999 (Vic), you give your express consent to the installation, use, and maintenance of optical surveillance devices at the Studio, and to the visual recording and observation of any activity you carry out at the Studio during your booking period, including any activity that would otherwise be a private activity. This consent applies to the areas identified in clause 10.6 and does not extend to the excluded areas in clause 10.7.
10.4 Your Guests must also consent. Recording a private activity without the express or implied consent of each party to it is a criminal offence in Victoria. Accordingly, you must, before any Guest attends the Studio:
- (a) inform them that the Studio is under continuous video surveillance, which areas are monitored, and that no audio is recorded; and
- (b) obtain their consent to being recorded.
You warrant that you have done both, and you indemnify us under clause 9 against any claim arising from a failure to do so. If a Guest does not consent, they must not attend.
10.5 No audio. Our surveillance system records video only. We do not record, listen to, or monitor private conversations. Use of a listening device to record a private conversation without the consent of each party is an offence under the Surveillance Devices Act 1999 (Vic).
10.6 Monitored areas. Cameras are installed at the entrances and in the studio area. All cameras are overt and visible, and signage is displayed at every entrance to a monitored area.
10.7 Private areas. Cameras cover the monitored areas in clause 10.6 only. No camera is installed in, or positioned to observe into, any private area of the Studio. If you need a private area during your booking, ask us and we will point one out.
10.8 Why we record. Footage is recorded solely for the purposes of assessing damage to property and theft of equipment.
10.9 Use as evidence. You agree that we may use, retain, and produce surveillance footage as evidence in support of any charge made to your card under clause 2, in any insurance claim, and in any dispute or legal proceeding.
10.10 Disclosure. We may disclose footage to law enforcement, our insurers, our legal advisers, the building owner or manager, and any party to whom disclosure is required or permitted by law.
10.11 Access. You may request access to footage of yourself by written request to hello@29macquarie.com.au. We will respond in accordance with the Privacy Act 1988 (Cth). We may refuse or redact access where providing it would unreasonably affect the privacy of another person, or where an exception under the Privacy Act applies.
10.12 No recording by you of others. Nothing in this clause permits you to install your own surveillance or recording devices at the premises, or to record any other person at the premises without their consent. You must obtain your own releases and consents from all models, talent, and Guests appearing in content you produce.
11. Insurance
11.1 You must hold, for the duration of your booking, public liability insurance for not less than $20 million per occurrence, and any other insurance appropriate to your activities, including workers compensation where required by law.
11.2 You must provide a certificate of currency on request. We may refuse access if it is not provided.
11.3 Our insurance does not cover your property, your equipment, or your Guests. You are responsible for insuring your own property and activities.
12. Cancellation and changes
12.1 By you. You may cancel or reschedule your booking with at least 72 hours' notice before your booking start time for a full refund. With less than 72 hours' notice, the hire fee is not refunded; the amount paid is held as a credit toward a future booking.
12.2 By us. We may cancel or reschedule a booking if the Studio becomes unavailable, unsafe, or unfit for use, or for any other reason beyond our reasonable control. In that case we will refund all fees you have paid for the affected booking. Subject to clause 8.6, that refund is your sole remedy and we are not liable for any other loss arising from the cancellation, including crew, talent, travel, or production costs.
12.3 We may refuse entry to, or immediately remove, any person who is intoxicated, abusive, unsafe, in breach of these terms, or who refuses a reasonable direction. We may terminate your booking immediately in those circumstances, with no refund, and you remain liable for all amounts under these terms.
13. Privacy
13.1 We collect and handle personal information, including surveillance footage, in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.
13.2 Questions, access requests, and privacy complaints should be directed to the Operator at hello@29macquarie.com.au.
14. General
14.1 Entire agreement. These terms, together with your booking confirmation and any house rules provided to you, are the entire agreement between us and supersede any prior discussion or representation.
14.2 Variation. We may amend these terms from time to time. The version in force at the time you make a booking applies to that booking.
14.3 Severability. If any provision is found to be void, unenforceable, or an unfair contract term, it is severed and the remaining provisions continue in full force.
14.4 Survival. Clauses 2, 6, 7, 8, 9, 10, 13, and 14 survive the end of your booking.
14.5 Waiver. A failure by us to enforce any provision is not a waiver of it.
14.6 Governing law. These terms are governed by the laws of Victoria, and you submit to the non-exclusive jurisdiction of the courts of Victoria and the courts of appeal from them.
14.7 Contact. 29 Macquarie Street Pty Ltd, ABN 63 701 124 692, 29 Macquarie Street, Prahran VIC 3181, hello@29macquarie.com.au.
